Several electronic cigarette companies have settled with the Vermont Department of Justice after being sued by Attorney General T.J. Donovan.
MONTPELIER — T.J. Donovan, the Attorney General for Vermont, announced that several electronic cigarette companies had reached settlements with his office in the conclusion of a period of ongoing litigation.
These companies were sued for violations of Vermont’s Delivery Sales Ban and the state Consumer Protection Act.
Under the settlements, the companies resolved these illegal complaints about having sold electronic cigarettes, e-liquids, and other tobacco product paraphernalia to individual consumers.
According to state law, it is illegal to sell electronic cigarettes and vaping products over the internet to individual customers in Vermont.
The total the companies paid was $157,500 in civil penalties to the State of Vermont.
These settlements also come on the heels of another $150,000 settlement announced in December against TPB International.
The company, in this case, unlawfully sold electronic cigarettes through its website.
“Online sales of electronic cigarettes, or any tobacco products, to individual Vermont consumers are illegal,” said Attorney General Donovan in a recent press statement.
“I am pleased that these websites will no longer be shipping products to Vermont.”
The press statement indicates that these “settlements Resolve Violations of State’s Delivery Sales Ban and Consumer Protection Act.”
Here are the following companies that settled in the case related to the affairs mentioned by Donovan’s office:
Puff E-cig settled for $90,500.
SV3, LLC settled for $35,000.
Atlantic Intertech, LLC settled for $22,500.
Westside Vapor, LLC settled for $5,000.
EcigCharleston, LLC settled for $1,000.
Planet Vapor, Inc. settled for $1,000.
Vapin by the Beach settled for $1,000.
Vape Vibe, LLC settled for $1,000.
A Perfect Vape, Inc. settled for $500.
“This law was expanded in 2019 to include tobacco substitutes (including electronic cigarettes), substances containing nicotine or otherwise intended for use with a tobacco substitute, and tobacco paraphernalia,” indicates another press statement.
“The Vermont Department of Liquor and Lottery conducts compliance checks of online retailers to determine compliance with this law.”
